Model Release Form

I hereby give MARKED permission to use pictures and/or videos, (if any are taken) and waive any rights to the photographs and the use and reproduction of them, for any purpose without any compensation to me. All negatives and positives, together with the prints shall be considered the sole property of MARKED, you are of course welcome to them.

Equipment Rentals

I understand and accept the responsibility for all rental equipment supplied by the Sponsors or Operator. If it is damaged or lost, I agree to pay all costs related to the replacement or repair of the lost or damaged item(s). As a VIP Member, I am entitled to a 50% discount on all rental equipment for me to use while visiting the park.

TO BE COMPLETE ONLY BY PLAYERS USING THEIR OWN EQUIPMENT

1. I understand that MARKED is a FIELD PAINT only facility, offsite paint cannot be used on-site, not even to Chronograph.
2. I understand that MARKED, items such as bags, pods, mags, hoppers, vehicles, but not limited to, may be subject to inspection upon entry/exit during the day/event, please refer to the prohibited item section online for details prior to playing today if unclear.
3. Barrel Bags MUST be on markers at all times in dead boxes and staging and must be installed prior to the installation of a tank.
4. Masks must be worn at all times when entering the playing zone and can not be removed for any reason, if you encounter an issue with your equipment or mask, please ensure you notify staff immediately.

Members Daily field rules to follow:

1. Anyone caught buying paint for a non-member will have their membership revoked on the spot.
2. I understand that MARKED has a Chronograph speed of 280FPS, I will Chronograph twice a day (AM&PM) during my visit.
3. I understand that paint purchased during my visit can not be taken off-site and brought back to use, Marked does NOT store paint for anyone, please buy what you need for the day. 
4. Members will ensure they sign in to facility staff at the shop daily.
5. Members will ensure while playing with renters they are not overly aggressive.
6. Membership is fully automated (monthly/yearly), memberships that have not been processed by the system will automatically be charged 2 days after the initial try and are subject to a 7% Facility Fee.  Memberships that do not go through within 7 days of the initial try are canceled automatically.
7. Membership Cancellation MUST be sent 15 days in advance to Play@Marked.ca in writing.
8. Memberships are annual for the season, typically open from April to Oct in any calendar year.  Monthly and year rates are the same, monthly rates don't stop in the winter, they are a reduced up front cost.
9. Failure of any of the above can be cause for termination of your membership, please note MARKED reserves the right to terminate your membership at any point, shall it deem you have intentionally gone to harm the business without cause.

RELEASE OF LIABILITY, WAIVE OF CLAIMS,

ASSUMPTION OF RISK & INDEMNITY AGREEMENT

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS,

INCLUDING THE RIGHT TO SUE

(ASSUMPTION OF RISK, RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT)

By signing this document you will waive certain legal rights, including the right to sue

ASSUMPTION OF RISK

1. I, the undersigned, wish to play Paintball and/or Laser Tag and/or Airsoft. I recognize and understand that playing Paintball and/or Laser Tag and/or Airsoft (hereinafter called the ‘Game’ involves certain risks. Those risks include, but are not limited to, the risk of injury resulting from possible malfunction of the equipment used in the Game and injuries resulting from tripping or falling over obstacles in the Game playing field. In addition, I recognize that the exertion of playing the Game could result in injury or death.
2. Despite these and other risks, and fully understanding such risks, I wish to play the Game and hereby assume the risks of playing the Game. I also hereby hold harmless the ‘Sponsors’ and indemnify them against any or all claims, actions, suits, procedures, costs, expenses (including legal fees and expenses), damages and liabilities arising out of, connected with, or resulting from my playing the Game, including, without limitation, those resulting from the manufacture, selection, delivery, possession, use or operation of any and all equipment used in the Game. I hereby release the Sponsors from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, my representatives and assigns. I hereby certify to the Sponsors that I am in good health and do not suffer from a heart condition or any other ailment which could be exacerbated by the exertion involved in playing the Game. Alcohol is not permitted on our site, players will be ejected.

RELEASE OF LIABILITY, WAIVER CLAIMS AND INDEMNITY AGREEMENT

In consideration of participating in the Game, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have, or may in the future have, against

MARKED O/B D.MILITKY,

their directors, officers, employees, agents and representatives (all of whom are hereinafter collectively referred to as ‘the Releasees’);

2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the Game due to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES;

3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my participation in the Game;

4. That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns, in the event of death.

PLEASE READ CAREFULLY

I HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
